I was going to ask a similar question. Wanted to use pix in a project I'm working on. No part of the project would be bought/sold, just publicly displayed.
Well I'm not NIN but I have shot them twice on a pass, and on a pass they allow use of the photos shot on that pass in one's portfolio or on a Web site* or if you want to make your own prints for your own use and display them, even,
as long as you're not using them commercially or for merchandising purposes, so I can't imagine why they would forbid people from using pictures shot otherwise, like in this relaxed camera policy, in the same way.
They also allow use of non-pass-authorized photos on Flickr and allow them to be API'd over to this site. It's not like they don't already know people are taking thousands of pictures of them.
There are other legalities involving pictures taken in this kind of environment, which I don't want to go into here, but you can PM me if you have questions. However, even though I am not speaking for NIN, being just a regular person who has nothing to do with them, I am fairly sure that you would be allowed to use them for a portfolio and in a project.
As long as you don't use them commercially you should be fine. I plan to take pictures and I will use them on my Web site, Flickr, and possibly in my portfolio, just as I've done for many other NIN shows and dozens of other band's shows. I know NIN is aware of where I'm using them and nobody has told me to stop yet.
*Note that
when shooting on a pass, I had to disclose the publication and/or Web site that the pictures would be appearing in. But all you guys don't have to worry about that since you're not shooting on a pass. The rules are different in some aspects, legally speaking.
Edit: this doesn't necessarily mean you can go take pictures and have a magazine/newspaper publish them. I can't speak to that; you should contact NIN management if you are approached by a publication or wish to submit pictures for editorial use.
I highly doubt they expect people to take video or pictures and then not share them with anyone. They surely expect them to be on Flickr if nowhere else and for people to use the API to have them flow over to the image galleries here on nin.com.
If Trent wishes to come here and give me a "wrong" I would happily take being corrected. :-P
But he won't. Don't worry, if you're not selling them I can't imagine they'd have a problem with anything else.
Edit: I am not your attorney, etc. Do not misconstrue advice on a message board for anything "official." I'm telling you what my personal experience is and what I plan to do.
