At least i paid with paypal and i'll be sure to open dispute if it doesn't arrive in 2-3 weeks, that's all. email was sent already... \/ Edited 1 time(s). Indeed. I appreciate getting it early, but releasing it early doesn't help when you know you're already past or nearing your current stock amounts.

I don't see how that makes a difference. The number of orders placed is independent from shipping dates. At the end of the day they still had the same amount of orders by/on the 27th regardless if some of them were shipped early. Clear as mud?

As soon as we receive them, we will have your order shipped out ... ... i may seem overly impatient, but in 2011 i lost 3 CDs in mail, one of which was irreplaceable, and for other 2 it was too late to open dispute. as of today, i expect something much more valuable/collectible in mail than GDT. peace

Odd, they gave the reason for the delay as due to the fact that they were shut between Xmas and New Year, but an automated response I rec'd soon after the original request said they were in between 8am and 6pm every day over that period. Think they got more wrong on this one than right. Shame. Order now placed with Amazon UK.

I don't know what I'll do with the "Topspin-Fulfillment-Copy", IF/When it might turn-up, except 'maybe' sell-it (Still-Sealed) to someone who would Appreciate it, and give it a Good Home. I will NOT Be doing anymore "Pre-Orders" in my life! For Anybody! I know I always tell myself that,,, and then I do it anyway,,, [ACK!], but I'm thru, for sure, by now! I will now always wait until 'Release-Day-Tuesday',,, or wait even longer,,, for it to turn up in the 'Buy-Sell-Trade-Used-Shops'. and I'd STILL Obtain it Faster than 'Topspin' can cough it up! (+Plus: No S/H-Charges!). -D.

Have you never had ANYTHING backordered in your entire life? I mean, that shit happens all the time...not just with NullCo or Topspin. Unless you NEVER receive an item or you don't get premium overnight shipping (if paid) then I just can't see a legal issue. Did you pay for overnight shipping with a guaranteed date of delivery?

My point is that when I made my purchase I entered into an agreement with Topspin to exchange money for a product that would be shipped no later than December 30th as stated on their site. They did not provide the product or service (shipping) that they stated they would. Not only is this a breach of our agreement it also constitutes false advertising. They don't even physically have possession of the items they're selling. I paid a premium to pre-order the item to have delivered by a certain date. That didn't happen. I can now obtain this for much less, and more quickly than Topspin can deliver. I just received an email saying they expect to ship my CDs on January 16th. No thanks. I'll be canceling my order.

If I order from Amazon, for instance, I'm given a delivery date between (this) date and (another) date about a month later. I understand why you would be pretty angry when you've been told a specific date for delivery, and I think you have every right to take some sort of legal action.

OK, you said shipped by the 30th, but did not state a date it was suppose to be delivered by. I've ordered many, many things from various stores, including amazon. There have been times when all or part of my order has been back ordered AFTER the ordering and payment part goes through and a PROJECTED shipping/delivery date is stated. If you understand that there is a disconnect between the website where you place your order from and the distribution center or manufacturer where items are, then you'd understand the whole concept of shopping/purchasing online. It can be flawed, especially when you purchase something that doesn't even exist at the time you order...shit happens. I can see where a large corporation, such as Amazon, would have priority over a small company when it comes to who gets a final product for their customers.

The release was stated as the 27th and they are shipping within 72 hrs. I was incorrect when I said "delivered" by a certain date. Should have been "shipped" by a certain date. Nowhere did they tell me the shipping date was projected. The site still says "the CD ships within 72 hours" yet they won't even have the product for another week. So that's a lie and that's false advertising. I won't go into your other remarks pertaining to my lack of understanding. Ben, Amazon's price is $13.88 with free shipping. I paid Topspin $19.80 (including shipping). I had no problem paying for the shipping as I expected that I would receive my CD sooner than Amazon could get one to me with free shipping. Nowhere have I stated I am planning on taking legal action. If I were I certainly wouldn't discuss it here. I do feel what they advertise isn't what they're delivering. My point is Topspin had weeks of notice to deliver a product to me within my reasonable expectations. People in Europe that ordered after me have received theirs. Pre-ordering a CD three weeks before it comes out and not receiving it until a month after it's been released is quite frustrating and in my opinion, unprofessional. Apathy toward this type of behavior only perpetuates the problem. I'm simply stating my opinion that Topspin is doing a lousy job. Had they simply responded to me with something other than a form letter (email) I would not be posting about this.
