Plaintiff was attending school in the Commonwealth of Kentucky. Kentucky is across the Ohio River from Cincinnati so I'm assuming the lawyer practices in both states, but the lawsuit was filed in Cincinnati -- Mom and son are not from Ohio.

The school nurse called mom to pick up the kid, not an emergency team that life-flighted him to a hospital and a "friend" helped remove his pants in the john, not the teacher. A cold compress will relieve a second degree burn (red and blistered) and the boy gets an afternoon off. Being "boy" maybe he tried taking it apart, or dropped it several times, or something poked it in his pocket.
What you do is take the pants back to the store with kid in tow, show them his little burned spot and ruined iTouch. For not being an idiot
(filing a lawsuit) they'd replace it on the spot and maybe throw in a few freebies.
